I, the above-named Testator, being of sound mind, not acting under duress or undue influence, and fully understanding the nature and extent of all my property and this disposition thereof, do hereby make, publish, and declare this document to be my Last Will and Testament ("Will"), and hereby revoke any and all other wills and codicils heretofore made by me.
I devise and bequeath all the residue of my estate, including all property, real and personal, wherever situated ("Residual Estate"), to my heirs-at-law, to be distributed in accordance with the laws of intestacy of the Governing Law.
Hereinafter known as the "Beneficiaries."
I hereby nominate a Guardian for any minor children I may have at the time of my death, known as ▇▇▇▇ ▇▇▇▇ with a mailing address of ("▇▇▇▇▇▇ ▇▇▇▇ ▇▇"), who shall bear unlimited power to act as caretaker for all minor children in this Will which includes but is not limited to educational matters, medical needs, and day-to-day decision-making abilities.
It is my intention under this Will to specifically exclude the following individuals from receiving any portion of my Residuary Estate or inventory:
Aside from my Residual Estate, I would like to assign the following assets to specific parties that may or may not be named as Beneficiaries under this Will:
Hereinafter known as the "Special Bequests."
To receive any gift or property under this Will, an individual must survive me by 30 days. If the Beneficiary should predecease me, then any property that they would have received either through the Residual Estate or a Special Bequest shall be distributed to heirs-at-law, equally.
I nominate and appoint Portia McDonald with a mailing address of ("'Personal Representative"), as Personal Representative of my estate and I request that they are appointed temporary Personal Representative under the probate process if they so apply.
My Personal Representative shall have and may exercise the following discretionary powers in addition to any common law or statutory powers without the necessity of court license or approval:
I direct that all my debts and expenses of my last illness, funeral, and burial be paid... I further direct that my Personal Representative shall pay out of my estate any and all estate and inheritance taxes...
Unless required by the court or applicable law, no bond shall be required of the Personal Representative... If a bond is required, no surety shall be necessary.
If any beneficiary under this Will contests or attacks this Will or any of its provisions, any share or interest in my estate given to that contesting beneficiary is revoked...
I direct that the representation by a guardian ad litem of the interests of persons unborn, unascertained or legally incompetent to act... be dispensed with to the extent permitted by law.
Whenever the context permits, the term "Personal Representative" shall include "Executor" and "Administrator"... All references to the Internal Revenue Code shall mean the Internal Revenue Code of 1986 or any successor Code...
The interest of any beneficiary in this Will, shall not be alienable, assignable, attachable, transferable nor paid by way of anticipation... and shall not be subject to the interference or control of creditors, spouses or others.
I do not wish to include specific provisions for the care of any pets under this Will. If I have any pets at the time of my death, I direct that they be placed under the care of my Personal Representative...
I request to include the following wishes and instructions as part of my Will: I wish for my ashes to be scattered in the Atlantic Ocean.
This document shall be governed under the law located in the State of Alabama.
Any decision by my Personal Representative with respect to any discretionary power hereunder shall be final and binding... Unless due to my Executor's own willful default or gross negligence...
I, Johan Björnlin, hereby declare that I signed and executed this instrument this Will, and that I signed it willingly in the presence of each of the undersigned witnesses...
